Roundtable Discussion: Forced Organ Harvesting from Living People – Past, Present, Future

June 9th, 2022: A roundtable discussion on forced organ harvesting was held by Doctors Against Forced Organ Harvesting.

During the discussion, Professor Martin Elliott commented that the recent Advisory published by Global Rights Compliance provides important guidance for medical institutions to take responsibility and avoid complicity.

“[Global Rights Compliance] is a group of lawyers trying to help – particularly medical and academic institutions, and industry as well – find … forms of words which would allow them to underwrite the legal relationship with Chinese authorities,” said Professor Elliott.

“For example, many Western universities and professional bodies have strong financial reasons to be closely associated with China.

“The Global Rights Compliance … they recognise that any of these organisations – academic, medical and business – need to do three things to ensure that they have an appropriate ethical framework:

First, they need to establish a human rights commitment within their own organisations, to prevent involvement in unethical practices (including transplantation).

Second, that they must conduct human rights due diligence processes, to identify, prevent, mitigate and account for unethical medical and transplantations risks.

Third, they should disengage from any relationship where such unethical transplantation is not preventable, not mitigatable or not remediable.

“That seems to me to be [an] extremely important construct, because it transfers the accountability from searching the problem in China, to those people who are actually dealing with them, as groups.”

“I think this is a very important step.”
